Washington Consumer Health Data Privacy Policy

This policy supplements our Privacy Policy and Biometric Data Policy & Written Release for consumers covered by Washington's My Health My Data Act (MHMDA). Washington law defines "consumer health data" to include biometric data, so the face-geometry data we process is covered even though we collect no information about your health.

Consumer health data we collect, and why

The only consumer health data we collect is biometric data: facial-recognition embeddings (a numerical representation of your face geometry) derived from the selfies you choose to upload. We collect and use it for exactly two purposes: (a) keeping your AI-generated photos consistent with your real face ("drift test"), and (b) verifying that every upload depicts you and only you. We do not collect health conditions, diagnoses, treatments, medications, reproductive or sexual health information, or precise location data, and we draw no inferences about your health.

Sharing and sale

We do not share consumer health data as defined by Washington law, and we do not sell it (and never will without the separate signed authorization Washington law requires, which we do not seek). Your biometric data is disclosed only to processors acting under binding contracts on our behalf: fal.ai (model training and image generation), AWS Rekognition (safety screening), Supabase (secure database storage), and Cloudflare R2 (photo storage). A current list is always in our Privacy Policy.

Your consent

We collect biometric data only after you give separate, specific, opt-in consent through our Biometric Data Consent — never through mere acceptance of general terms. You may withdraw consent at any time.

Your rights

If Washington's law applies to you, you have the right to: confirm whether we collect, share, or sell your consumer health data and to access it, including the processors we've disclosed it to; withdraw consent; and have your consumer health data deleted, including by our processors. To exercise any right, contact [email protected]. We will respond within the timeframes Washington law requires. If we decline a request, you may appeal by replying to our decision; if your appeal is denied, you may contact the Washington Attorney General at www.atg.wa.gov/file-complaint.
